DUI Lawyers in Holland, NJ

New Jersey has some of the toughest laws in the country regarding drunk driving, specifically driving while intoxicated (DWI) or driving under the influence (DUI). Notably, there's a strict prohibition against plea bargaining to reduce DWI charges. A first-time conviction for drunk driving can result in hefty fines, a possible jail sentence of up to 30 days, and a 90-day suspension of your driving privileges, not to mention additional financial repercussions that can linger.

If you find yourself arrested for driving under the influence, prepare for mandatory license suspension, the potential for jail time, and a staggering minimum of $6,575 in fines and surcharges if convicted. If your insurance company catches wind of the conviction, you may have to pay significant premium increases over the next three years

The truth is that New Jersey's courts are notoriously harsh on people arrested for DUI and DWI. The penalties are substantial and can have a lasting impact on your freedom, work, and life as a whole. Fortunately, working with a quality DUI lawyer - like Edward G. Appel - can help prevent serious charges from going on your permanent record.

DUI Field Sobriety and BAC Tests in New Jersey

Authorities use several types of tests to ascertain whether a driver is under the influence. These tests consist of field sobriety tests, breath analysis, and blood examinations. However, the outcomes of these evaluations can sometimes be misleading. Edward G. Appel has the expertise to recognize and demonstrate the inaccuracies in these results to protect your freedom.

What Happens After You're Arrested for a DUI in New Jersey?

Most people feel anxious and frightened after getting arrested for DWI because they are uncertain about what comes next. That's why it's so important to understand what to anticipate following a DUI arrest - so you can prepare yourself. The initial step in the legal process is the arraignment, which is a court session that occurs soon after your DUI arrest. At this session, the judge will outline the charges that have been brought against you and give you a summary of the penalties you might face. A significant number of traffic cases are settled with plea agreements, but prosecutors are prohibited from providing these arrangements in DUI cases.

That means you have two options: You can plead guilty and face the full penalties of a DUI conviction, or you can plead not guilty and continue to fight for your rights. There is a chance that your charges could be dropped before the trial, but this usually occurs only if there are significant weaknesses in the prosecution's evidence. The judge in your case will decide the outcome after both parties have presented their evidence. Instead of going through this complicated legal process by yourself, call a New Jersey DUI lawyer like Edward G. Appel. It could mean the difference between years of hardship and a clean record.

Understanding DUI Charges in New Jersey: Criminal vs. Traffic Offenses

In New Jersey, driving under the influence (DUI) is categorized as a traffic violation, though the consequences of DUI charges are severe. However, a license suspension is not mandatory for all offenders. First-time offenders arrested with a blood alcohol content (BAC) level under 0.15% may avoid suspension if they quickly install an ignition interlock device (IID) in their personal vehicle. Other potential penalties associated with a DUI conviction can include community service, fines, and, in certain situations, imprisonment. Depending on the circumstances of your case, working with experienced DUI attorneys in Holland, NJ, can help you avoid some or all of these punishments.

You may also be charged with DUI if you operate a vehicle while under the influence of any intoxicating substances, regardless of whether they are illegal, prescribed, or available over the counter. The specific type of drug is irrelevant; what matters is your impairment and inability to drive safely.

If convicted of a drug-related DUI, you could face:

  • A license suspension of 7 to 12 months
  • Up to 30 days of incarceration
  • Fines and surcharges exceeding $3,500

A second conviction may result in a jail sentence ranging from 2 to 90 days and a 2-year suspension of your driver's license, along with increased fines and surcharges.

Here's What to Expect After Your 1st DUI Charge in New Jersey

Many individuals charged with DUI believe that they will receive leniency if it's their first offense, but this is not always true. First-time offenders may incur significant fines, up to 30 days of incarceration, and the compulsory installation of an ignition interlock device (IID) in their vehicle. Penalties increase for first-time offenders with a BAC of 0.10% or more at the time of arrest.

As mentioned above, these individuals face a longer mandatory IID installation period, larger fines, and the potential for jail time. First-time offenders will also experience a rise in their auto insurance premiums after their arrest. The State of New Jersey takes DUI offenses seriously, even for those encountering it for the first time.

Here's What to Expect After Your 2nd DUI Charge in New Jersey

Defendants who are charged again within 10 years of a prior conviction face increased penalties for a second DUI offense. They may be fined up to $1,000 and must serve at least 48 hours in jail, with a maximum of 90 days. Additionally, a second conviction can lead to 30 days of community service, a one-to-two-year license suspension, and two to four years of mandatory ignition interlock device (IID) use. These consequences, along with higher insurance rates, can significantly affect a repeat offender's life.

 Criminal Defense Lawyer Holland, NJ

Here's What to Expect After Your 3rd DUI Charge in New Jersey

The court has the authority to impose stringent penalties on individuals with two or more DUI convictions within the past decade. If a person is found guilty of DUI for the third time in a 10- year span, the court may sentence them to 180 days in jail along with a $1,000 fine. Those convicted for the third time will lose their driving licenses for a duration of 8 years.

The court may also require these offenders to install an ignition interlock device for a period of two to four years after their driving rights are reinstated. Because third-time offenders are categorized as high-risk drivers, they will likely face significantly increased auto insurance rates. These individuals should anticipate an extra $1,500 surcharge on their auto insurance each year for three consecutive years. Given that these penalties can have a serious impact on both personal and professional aspects of life, it is crucial to contest the charges with help from a skilled DUI attorney like Edward G. Appel.

How Do DUI Lawyers in Holland, NJ, Help with DUI Cases?

Hiring a well-respected DUI lawyer often has a major impact on your case's outcome. Great attorneys will get started immediately by taking a deep dive into the particulars of your case. They'll look for issues with the prosecution's evidence, such as:

  • Did on-scene officers follow protocol when storing samples and administering chemical tests?
  • Did officers have a valid reason for pulling you over to begin with?
  • Are the results from your chemical tests reliable?

If not, a lawyer can expose these concerns, potentially resulting in the dismissal of the charges. These are just a few examples of how an attorney can challenge DUI charges for you.

At the law firm of Edward G. Appel, we thoroughly investigate every detail when defending our clients. In fact, our clients benefit from personalized attention, support, and a meticulously crafted defense that aligns with the specific details of their arrest. We're not satisfied until our lawyers have explored every potential defense strategy for your case. Through comprehensive investigation, negotiation, and, when required, litigation, we strive to achieve the best possible outcome for our clients.

Clients choose us not to simply enter a guilty plea but to robustly contest the charges against them. While no attorney can promise specific outcomes, we assure you that we will continue to advocate for you until you decide otherwise. We examine every detail of your case to ensure all necessary evidence is gathered and the right motions are submitted. There are motions available to suppress evidence if your constitutional rights were infringed upon during the stop, as well as motions to limit or dismiss evidence under particular conditions. Contact us today to evaluate your case. We are eager to help you, even if it's just to provide an initial consultation.

2. Downplaying DUI Consequences

Understanding the implications of a conviction is a key part of strategizing your defense and can influence your defense approach. The U-pick festival is open through April 27.

Imagine nearly 8 million tulips blooming over acres of farmland in New Jersey. The flowers burst with colors and seem to disappear on the horizon.

Then, picture a 100-foot-high, handcrafted Dutch windmill with an observation deck to take in the spectacle.

It’s no mirage.

The opening of the Dutch Dream Windmill is a milestone in the Holland Ridge Farm’s efforts to create an iconic, family-friendly destination to experience Dutch heritage. It also features traditional vendors, games and of course, millions of tulips that visitors can pick, buy and take with them.

The farm is in Cream Ridge, Upper Freehold Township in Monmouth County.

“This is something completely unique,” Patrick Marini, the farm’s marketing director, told NJ Advance Media. “It’s a real cultural experience.”

But wait, there’s more.

The windmill – built over the past two years in Holland, and then assembled here by the Dutch Verbij Construction Company – has a wind-propelled grind stone that will be used to make a vodka-like alcoholic spirit that will be bottled and sold at the farm.

The grand opening of the windmill will be Wednesday, April 16. Then, Dutch Fest, a four-day celebration of Dutch culture, starts the next day and runs through Sunday.

In all, the tulip bloom is scheduled to conclude at the end of the month.

“The farm runs on Mother Nature’s schedule,” said Kristie Fischer, an executive assistant at a pharmaceutical company who moonlights on weekends as a sales assistant at the farm during tulip season. “That’s my happy spot. After working in corporate life for 38 years, the flowers are a nice distraction.”

Admission to the farm on weekdays is $17 for adults, and the flowers are 50-cents per stem. On weekends, tickets are $20 and the price per stem is $1.

Marini said this is the seventh year for the “u-pick” tulip festival and they expect thousands of visitors.

But growing activity on the 300-acre farm goes on for months. Greenhouses produce a prolific amount of tulips from November to May that are sold in Whole Foods Markets, Lidl and ShopRites, and distributed to other stores along the East Coast, Maraini said.

The family-run greenhouse farming business has been going on for 40 years in New Jersey and stretches across the ocean to the great-grandfather of Casey Jansen, 75, who has carried on the tradition in the Unites States.

“I love tulips,” Fischer said. “It’s breathtaking when you go to the farm to see them.”

This New Jersey Farm Feels Like You’re in the Netherlands for Tulip Season—and It Opens Today

Holland Ridge Farms is run by a Dutch family who wanted to recreate the iconic tulip blooms in the U.S.

Comments

Walking through the rows of blooming tulips on this 300-acre farm is like being enveloped in a kaleidoscope of spring colors. As far as the eye can see in every direction are sheets of pink, orange, yellows, reds, and violet, totaling a whopping 8 million tulips of about 100 varieties—and the most amazing part is, they’re all for the taking.

Though the flowers may be most associated with the Netherlands, this scene is actually in the unexpected location of Cream Ridge, New Jersey, at Holland Ridge Farm.

Since 2018, the farm has been hosting its annual U-Pick Tulips Spring Spectacular, drawing visitors from as far as Puerto Rico to curate their own tulip bouquets for just $1 per stem on weekends, or 50 cents each on weekdays.

“Be ready to be amazed—and also be ready to pick,” spokesperson Patrick Marini told Travel + Leisure. “We provide the buckets, and you don’t need anything to cut them. To pick, all you do is twist and pull.”

The Monmouth County location—located about 90 minutes south of New York City or an hour northeast of Philadelphia—may seem like a surprising spot for such massive tulip fields. But they’re actually an ode to the home country of a family of Dutch immigrants, led by Casey Jansen Sr., dubbed the Dutch Walt Disney for turning his dream of sharing the Netherlands with the U.S.

“When you visit the farm, it truly feels like you’re in the Netherlands,” Marini said. “From wooden shoes to stroopwafels and actual Dutch employees wandering around … not only do we plant the most tulips, but we also plant the most varieties.”

This year, they’re adding even more of a touch of Holland’s culture with the debut of a traditional windmill, called Dutch Dream, rising nearly 100 feet high. Visitors will be able to climb inside and better understand how a windmill works. “We think this will be one of New Jersey’s newest icons,” he said, adding that it will be "one of the most breathtaking view in the whole state” seeing the spring colors from above. As for the name, Marini said "it was chosen because it signifies our owner's journey from Holland to the U.S. and what he’s been able to accomplish."

The new windmill will be introduced to the public on April 16. The following Thursday through Sunday, the farm will host Dutch Fest with traditional food, games, and culture.

What to Know

While the tulips draw the crowds, the farm also has a bakery, Little Sprouts Feeding Zoo, and free hayride shuttle. Gator Utility Vehicle rides are available for those with a valid handicap placard, while others can reserve rides for a fee. Horse and carriage and pony rides are also offered on weekends.

There’s also a farmers and makers market hosted by Central Jersey community pop-up shopping experiences initiative Asbury Fresh on weekends from April 17 to April 25, featuring artisans, food purveyors, and farmers from the region, as well as food trucks and spring themed photo opps. Dog & Ram Spirits from Mannington, New Jersey, will serve flower-themed cocktails, alongside mocktails and gourmet sodas.

While the spring festival is its trademark event, Holland Ridge Farms also hosts U-Pick Sunflowers: Fall Festival in September and October and a holiday light-up event with 30,000 illuminated tulips called U-Pick Tulips: Winter Wonderland from November through January.

But for now, the effort is on its tulips, which have turned the farm into a must-experience in the Garden State. “To plan a festival and maintain a farm as big as ours is a true labor of love that starts in early November,” Marini said. “Seeing everyone take photos, pick flowers, and enjoy our happy place is what keeps us going … it brings us so much joy and we truly look forward to it year after year."

Above all, this is the type of experience that can’t be completely understood until a visit. “Pictures capture the beauty and color, but they still do not do justice to the scale of the farm and all it has to offer,” he said. “You really need to see it to believe it.”

New Jersey is well known for its flower festivals, and one mega fest ranked No. 1 on a national list of tulip festivals.

Car rental company SIXT studied the best tulip festivals in the country, and obvi named Holland Ridge Farms in Cream Ridge the best. There are 8 million tulips of varying colors (and 100 different varieties) planted every season on the 300-acre farm. The bulbs come directly from Holland!

Aside from the gorgeous photo ops, when you visit during April and May, there will be food trucks, farm animals, a feeding zoo, a picnic area, pony rides, a tractor-pulled hayride, Dutch souvenirs, a bakery, a tulip planting museum, and of course, u-pick flowers.

Although opening day for the festival hasn’t been announced, Holland Ridge has teased some of this year’s activities. A direct-from-Holland 100-foot-tall windmill will be unveiled this year and will be open to visitors for $10 per person.

The farmers and makers markets will be set up every weekend. Dog & Ram Distillery will serve floral-themed cocktails on the weekends, in addition to mocktails and gourmet soda.

You can ride around the farm in a chauffeur-driven gator to get a more up-close-and-personal experience. Rentals are for up to four people, can be rented any day of the week, and cost $150 for 1 hour 45 minutes. Returning this year is a bus service from Port Authority in NYC to the farm on the weekends.

There are other perks the farm offers, too. You can order and ship tulip boxes across the country. There’s new merch this year, including tees, sweatshirts and hats to show off your “happy place.” And you can book an 8-day tour package to Holland through a partnership with Holland Ridge.

Holland Ridge is open throughout the year, with u-pick sunflowers during the Fall Festival and a new Winter Wonderland around the holidays.

According to SIXT, there have been 1,300 internet searches over the past month for Holland Ridge, in addition to 558,000 views on TikTok! Using Google Trends, SIXT analyzed search terms related to local tulip festivals, examined Country Living’s list of the best tulip festivals in the country, and then formulated rankings based on Google searches, TikTok views, and the number of tulips at the event, with data accurate as of March 5.

The Top 15 Tulip Festivals in the U.S., According to SIXT:

If you want to see more tulips, you can check out other beautiful farms in New Jersey, including Dalton Farms in Swedesboro, Johnson’s Corner Farm in Medford, and Snyders Farm in Somerset.

There are more flower festivals taking place this season as well. Branch Brook Park in Newark and Belleville celebrates its gigantic cherry blossom orchards with sporting events and festivals April 5-6 and 12-23.
